FieldSpartan Terms of Service

1. Who these terms are between

These terms apply to your use of the FieldSpartan mobile app (“the App”). The App is provided by Zona Vibes, LLC, an Arizona limited liability company (“we”, “us”).

By installing, signing in, or using the App, you agree to these terms. If you don't agree, don't use the App.

2. Who can use the App

You can use the App if:

  • Your employer has an active FieldSpartan platform account, and
  • Your employer has provisioned an account for you, and
  • You are at least 18 years old.

If any of those stops being true, your right to use the App ends.

3. Your account

  • You are responsible for keeping your sign-in credentials private.
  • You are responsible for activity that happens under your account.
  • Notify your employer and us at security@fieldspartan.com if you believe your account has been compromised.
  • We may suspend or terminate your account if you violate these terms or your employer instructs us to.

4. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App except as permitted by law.
  • Access or attempt to access another user's, business's, or customer's data without authorization.
  • Interfere with the App's security, infrastructure, or other users' use of it.
  • Use the App to violate any law or third party's rights.
  • Submit content (notes, photos, etc.) that is unlawful, harassing, or infringes someone else's rights.

5. Data ownership and use

  • Your employer's data is your employer's. Visit, customer, and operational data belong to the business that operates the FieldSpartan account. We process it on their behalf under our agreement with them.
  • Content you submit (notes, photos, procedure responses) belongs to your employer in the context of their business records. By submitting it through the App, you grant us the rights necessary to store, process, and transmit it as part of providing the service.

6. Software license

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for the purpose of doing your work for an authorized FieldSpartan platform business. This license ends automatically when your authorization does.

The App, its content, and all related intellectual property remain ours (or our licensors').

7. Third-party services

The App uses third-party services (Clerk, Google Maps, Sentry, and the FieldSpartan backend). Your use of those services through the App is also subject to their respective terms, where applicable.

8. Updates

The App auto-updates and may receive over-the-air updates while you use it. We may change features, add features, or remove features at any time. We will not knowingly remove a feature in a way that is intended to harm you.

9. Disclaimers

The App is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties — express, implied, and statutory — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or that it will work offline indefinitely.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the App.

Our total liability under or in connection with these terms will not exceed $25 or the amount your employer paid for App access in the 12 months before the claim, whichever is greater.

Some jurisdictions don't allow these limitations. To the extent they don't apply, our liability is limited to the fullest extent allowed by law.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from (a) your violation of these terms or (b) your misuse of the App.

12. Termination

You can stop using the App at any time. We can suspend or terminate your access at any time, including if your employer instructs us to or if you violate these terms. Sections that by their nature should survive termination will survive.

13. Changes to these terms

We may update these terms. Material changes will be announced in the App or via your employer at least 14 days before they take effect. Continued use after that date means you accept the new terms.

14. Governing law and disputes

These terms are governed by the laws of Arizona, excluding conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction.
